Buyer agrees to indemnify and hold harmless Scruff Club, its employees, agents, successors, officers, and assigns, from and against any suits, losses, claims, demands, liabilities, costs, and expenses (including attorney and accounting fees) that Scruff Club may sustain or incur as a result of any claim against it based upon negligence, breach of warranty, strict liability in tort, contract, or any other theory of law brought by Buyer, its officers, agents, employees, successors or assigns, by Buyer's customers, by end users, by auxiliary personnel (such as freight handlers, etc.) or by other third parties, arising out of, directly or indirectly, the use of Scruff Club products, or by reason of Buyer's failure to perform its obligations contained herein.

At buyer's request, Scruff Club may, at its own discretion, supply technical assistance and information with respect to products. Scruff Club makes no warranties of any kind or nature – expressed or implied – including any implied warranty of merchantability or fitness for any particular purpose, with respect to technical assistance or information provided by Scruff Club or its personnel. Any suggestions by Scruff Club regarding use, selection, application, or suitability of the products shall not be construed as an express warranty, unless specifically designated as such in writing and signed by an officer or other authorized representative of Scruff Club.

Further, Scruff Club is not responsible for the comments made in the customer reviews, nor when products are used in ways not suitable to their purpose (for example; product transferred into other containers; products used to correct skin conditions).

As the ordinary or otherwise use(s) of this product is outside the control of Scruff Club no representation or warranty – expressed or implied – is made as to the effect(s) of such use(s) (including damage or injury) or the results obtained.

The liability of Scruff Club is limited to the value of the goods and does not include any consequential loss.
